Attorney Alfredo Estrada recently filed a lawsuit against U.S. Citizenship and Immigration Services (USCIS) due to its delay in adjudicating an I-131, Application for Travel Document. The I-131, Application for Travel Document is required to be field when an individual has a family member who is a member of the U.S Armed Forces and the individual lacks a legal entry.
Attorney Estrada filed the lawsuit pursuant to the Administrative Procedure Act and the Mandamus Act. See 5 U.S.C. §§ 701-706; 28 U.S.C. § 1361. Once the lawsuit was filed, USCIS promptly responded to the lawsuit and approved the I-131, Application for Travel Document and issued an I-94 , Arrival/Departure Record demonstrating Parole in Place.
Going forward Attorney Estrada intends on filing for his clients’ adjustment of status to legal permanent residence.
