Today the United States Supreme Court, Chief Justice Roberts writing, ruled that the Trump administration rescission of the Deferred Action of Childhood Arrivals (DACA) program was arbitrary and capricious and did not comply with the procedural requirement that it provide a reasoned explanation for its action.

Attorney Alfredo Estrada, here at Burke Costanza & Carberry LLP, has been advising his DACA clients to renew their DACA status prior to this anticipated decision. He stated “My DACA clients are college students, nurses, and professionals. They are required, by law, not to have a criminal history. Although today’s ruling isn’t a policy decision regarding DACA, it does affirm that arbitrary and capricious standard, regarding agency actions, must be reasoned and comply with procedural requirements.”
